Use of images in web templates?

Postby rgallacher on Mon May 26, 2008 1:10 pm

Hi, I wonder if someone could clarify for me if I can use images in web templates. I plan to create a few web templates and make them available to download for free. I understand from the Terms of Use that I cannot distribute an image on a stand-alone basis, but would I be correct in thinking that I can use a cropped, resized image within a template? I'm happy to credit the photographer within my code.

I'd appreciate if someone could take the time to confirm this for me. Many thanks.

Hi Ruby,

Yes, that should be fine!  As long as the images are cropped, resized, and included in another creative work (i.e., the templates), I don't see any conflict with the license, at least in terms of the prohibition against distribution of stand-alone images.  As long as the other limitations don't apply (e.g., competing with morgueFile, offensive use, etc.), you should be able to use the images that way, even if you decide to sell the templates.

Credit to the photographers is very much appreciated, and most photographers also appreciate a quick note from you to let them know which photos you're using.

I would like to do something similar with some images in the archive if possible.

The images I plan to use would be artworked into web page and email template designs (cropped, resized and integrated into the design etc.)

The template designs would be free for people who have purchased the appropriate website/email builder software.

From reading your answer to Ruby, it seems that this should not infringe the license? Would permission be required for each photo from the author?

Thanks

Tim

Right -- as I understand your description of how you would use them, that does not sound to me like it would be a problem license-wise. You wouldn't need to get each photographer's permission since they grant that, via the morgueFile license, by uploading their work to the archive (i.e., the "Free Photos" section).

On the other hand, usually photographers like to hear about this sort of thing, so if you have time to contact them, I encourage doing so. Alternatively, there is a thread in the Inspiration forum where you can explain how you used photos from the archive, to give photographers some credit that way. That's all optional, but it's almost certainly appreciated!
